These Disclaimers are an integral part of the Terms of Service and apply to all use of azarestoration.com and all Services provided by AZA Builds LLC d/b/a AZA Restoration. By using the Site or engaging our Services, you agree to the following terms.

1. NATURE OF RESTORATION WORK

Restoration and reconstruction work involves inherent uncertainty. Hidden damage is common and may not be visible during initial inspection. As a result, estimates, timelines, and scopes are based on visible conditions at the time of inspection and may change once work begins. Changes in scope, cost, or schedule are normal and do not constitute error or misrepresentation.

2. HIDDEN AND PRE-EXISTING CONDITIONS

We are not responsible for conditions that are concealed or not reasonably detectable at the time of inspection, including hidden water damage, rot, structural issues, or microbial growth.

We also disclaim responsibility for:

• Pre-existing structural, mechanical, electrical, or plumbing defects outside the contracted scope
• Hazardous materials such as asbestos, lead, silica, or PCBs unless explicitly included in the contract
• Mold or microbial growth outside the defined remediation area or caused by ongoing moisture sources
• Structural or foundation issues unrelated to the covered loss
• HOA, condominium, or regulatory requirements not disclosed before contracting

Discovery of such conditions may require a change order and work stoppage if legally required.

3. THIRD-PARTY MATERIALS & MANUFACTURER WARRANTIES

We do not guarantee exact material matches, finishes, or product availability. All third-party products are installed per manufacturer instructions. Product warranties are provided solely by manufacturers. We are not responsible for product defects, recalls, supply shortages, or variations within manufacturing tolerances.

4. INSURANCE COVERAGE

We do not guarantee insurance approval or payment amounts. Insurance decisions are made solely by your carrier. We are not public adjusters and do not provide legal or coverage advice.

5. DESIGN AND ENGINEERING

Unless explicitly included, all architectural, structural, and engineering services are the responsibility of third-party professionals. We rely on their plans and are not liable for design adequacy.

6. SCHEDULE AND WEATHER

Project timelines are estimates and may change due to drying conditions, inspections, permits, insurance approvals, weather, material delays, or unforeseen damage. We are not responsible for consequential losses such as relocation costs or business interruption unless expressly agreed in writing.

7. CODE COMPLIANCE

Work complies with building codes in effect at the time of permit issuance. Any code changes after issuance are treated as additional, compensable work. Existing non-compliant conditions outside the scope are not included unless stated.

8. LIMITATION OF LIABILITY

To the maximum extent permitted by Virginia law:

AZA Restoration’s total liability for any claim shall not exceed the total amount paid under the applicable contract.

We are not liable for indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of income or business interruption
• Additional living expenses
• Loss of property value
• Emotional distress
• Storage or relocation costs

This limitation applies even if a remedy fails its essential purpose, except where prohibited by law (including violations of the Virginia Consumer Protection Act).

9. INDEMNIFICATION

Each party agrees to indemnify the other for third-party claims caused by their own negligence, to the extent allowed under Virginia law. This does not expand liability beyond Section 8.

10. NO PROFESSIONAL ADVICE

All content on the Site is for general informational purposes only and does not constitute legal, engineering, insurance, financial, or medical advice. You must consult licensed professionals for specific advice.

11. WEBSITE DISCLAIMER
